Terms and Conditions
Please read the following terms and conditions carefully before using this Géotech ViSit Anywhere Sharing and Archiving. Your use of this service indicates your acceptance of these terms and conditions.
Sharing and Archiving is a service provided by Géotech ViSit Anywhere that allows organizations to upload and distribute project archives and other data strictly for use in Géotech ViSit Anywhere.
The Sharing and Archiving is reserved for use by organizations that have at least one valid Géotech ViSit Anywhere license (level STANDARD EDITOR or above). It provides access by licensed users (level CONSULTATION and above), including users external to the organization who have been granted READ authorization to projects for the organization in question.
Géotech engages to archive all uploaded information and ensure integrity of the data as long as the organization in question has purchased at least one license (level STANDARD EDITOR or above) and continues to pay any supplimental charges based on storage volumes as described in this document. If these conditions are not met, the data may be removed from the Géotech ViSit Anywhere server without notice.
The purchase of one or more licenses by a single organization gives the organization's users (that is, users whose primary organization is the organization in question) the right to store 5 GB of data plus 1 GB per license (level STANDARD EDITOR or above) without additional cost. The cost of additional data storage is detailed in the Géotech ViSit Anywhere sales agreement.
Géotech reserves the right to audit all data uploaded to the Sharing and Archiving service for statistical purposes. Content judged to be inappropriate, including but not limited to the following: obscene or pornographic materials, materials that may incite hate and unauthorized copyrighted materials; will be immediately removed from the server and may result in additional legal proceedings.
ViSit Anywhere License Agreement
Please read the following terms and conditions carefully before using this SOFTWARE PRODUCT. Your use, distribution or installation of this web site and Géotech ViSit Anywhere indicates your acceptance of this License.
SOFTWARE PRODUCT here means Software, image files, all accompanying files, data and materials received with your order of Géotech ViSit Anywhere in addition to the information on this web site.
If you do not agree to any of the terms of this License, then do not install, distribute or use the SOFTWARE PRODUCT. If you have purchased the product from Géotech or an authorized distributor, reseller or any retail channel, you may return it unused, within thirty (30) days after purchase, for a refund of your payment less any incidental charges.
Warrantee covers defects in the software, which prevents successfully installing the software in the buyer's PC. Warrantee does not cover fitness of purpose, not meeting of expectations or needs in the mind of the buyer.
This SOFTWARE PRODUCT is for personal use only. It may be installed on one or more computers. Its component parts may not be separated for use in any way. All components accompanying the software are copyrighted by Géotech and may not be taken apart, modified, used or published with other software or means except with the SOFTWARE PRODUCT software and may not be distributed or copied in any manner.
This SOFTWARE PRODUCT, all accompanying files, data and materials, are distributed "AS IS" and with no warranties of any kind, whether express or implied. The user must assume all risk of using the program. This disclaimer of warranty constitutes an essential part of the agreement.
Any liability of Géotech will be limited exclusively to refund of purchase price. In addition, in no event shall Géotech, or its principals, shareholders, officers, employees, affiliates, contractors, subsidiaries, or parent organizations, be liable for any incidental, consequential, punitive or any other damages whatsoever relating to the use of Géotech ViSit Anywhere.
In addition, in no event does Géotech authorize you to use this SOFTWARE PRODUCT in applications or systems where Géotech ViSit Anywhere's failure to perform can reasonably be expected to result in a physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold Géotech harmless from any claims or losses relating to such unauthorized use.
Géotech ViSit Anywhere is licensed monthly and may be renewed from one month to the next or on an annual basis. At the expiration of the license the software must be completely uninstalled and may not be used. A license may be transferred from one user to the next without penalty, effective immediately upon transfer. Users who are thus unlicensed may NOT receive a new Géotech ViSit Anywhere license for the remainder of current month, plus an additional month. This is in keeping with Géotech’s policy of not providing floating licenses.
Géotech provides two classes of license, by user and by machine. In each case, whether licensed by machine or by user, the license is associated with a license level. The following license levels are available, CONSULTATION, STANDARD (EDITOR), POWER and ADMINISTRATOR. Essentially a CONSULTATION license provides users the ability to CONSULT information, a STANDARD license allows users to edit the DATA branch of a Géotech ViSit Anywhere project (in addition to all the features of a CONSULATION license). A POWER allows the user of all the STANDARD license feature plus the right to use an AD HOC set set of features advanced features defined by Géotech. The power license does not, in general, allow the user to administrate the SCHEMA branch of a Géotech ViSit Anywhere project. An ADMINISTRATOR license allows the user to modify the TYPES and SCHEMA branch of a Géotech ViSit Anywhere project (in addition to the user of all the features of a POWER license).
When licensed by user, a single, named user may install the software on any number of computers and is free to use all the features of Géotech ViSit Anywhere appropriate to their license level. All people using the software must have a valid Géotech ViSit Anywhere license.
A machine license can be installed on a single machine and used by any number of users. A machine is defined by its network name and an application identitfier. Géotech ViSit Anywhere service applications are also licensed using a machine license.
Géotech does NOT provide floating licenses. All users and services using Géotech ViSit Anywhere products must have either a user license or a machine license.
This Agreement constitutes the entire statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of France.
Géotech is the owner of the copyright of this SOFTWARE PRODUCT. All of its derivatives, title and accompanying materials are the exclusive property of Géotech. All rights of any kind, which are not expressly granted in this License, are entirely and exclusively reserved to and by Géotech. You may not rent, lease, transfer, modify, translate, reverse engineer, de-compile, disassemble or create derivative works based on this SOFTWARE PRODUCT. You may not make access to SOFTWARE PRODUCT available to others in connection with a service bureau, application service provider, or similar business, or use this SOFTWARE PRODUCT in a business to provide file compression, decompression, or conversion services to others. There are no third party beneficiaries of any promises, obligations or representations made by Géotech herein.
You may not disclose to other persons the data or techniques relating to this SOFTWARE PRODUCT that you know or should know that it is a trade secret of Géotech in any manner that will cause damage to Géotech.
This SOFTWARE PRODUCT and all services provided may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any French, State or City law is strictly prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. You agree to indemnify and hold Géotech harmless from any claims resulting from the use of this SOFTWARE PRODUCT, which may damage any other party.
